i've had a busy week. this is NOT how i had preferred to end it....



so, having been tipped to [livejournal.com profile] rapists_unite, i sent off a complaint to lj-abuse for encouraging illegal behaviour and for hate speech.
their reply... a) it's not encouraging illegal behaviour because it's not exactly giving tips/how-tos.
and, b) well, i didn't really get a response regarding my concerns of hate speech. i did get this...

While the material is distasteful, we cannot take any action. The content falls within the realm of material protected by free speech. LiveJournal attempts to preserve as much free speech as possible for its users, as long as that speech does not cross the line into invading another's privacy, violating local or federal law, or directly inciting violence or hatred against any specific, identifiable group regardless of whether that group is explicitly named in our Terms of Service. The content of the community in question does not meet that criteria at this time.

now. i'm still not sure how encouraging rape is anything but hate speech.
so, i asked the wonderful folks at lj-abuse if they considered rape to be an act of love.

i am waiting for their reply.

How can the TOS employees not realize that that community is directly inciting violence or hatred against any specific, identifiable group regardless of whether that group is explicitly named in our Terms of Service?

Hi I found this post via a link from a friends journal.


But the community DOES promote violence and illegal acts. It promotes hatred against people through promoting support for acts of violence. This being one of the worst acts of violence a human being must experience if they are a rape survivor.

I am beyond speechless and sick right now.

RCW 9.68.140
Promoting pornography -- Class C felony -- Penalties.

A person who, for profit-making purposes and with knowledge, sells, exhibits, displays, or produces any lewd matter as defined in RCW 7.48A.010 is guilty of promoting pornography. Promoting pornography is a class C felony and shall bear the punishment and fines prescribed for that class of felony. In imposing the criminal penalty, the court shall consider the wilfulness of the defendant's conduct and the profits made by the defendant attributable to the felony. All fines assessed under this chapter shall be paid into the general treasury of the state.

Since LJ is a for profit company I would think this applies to them.

I guess it is time to email the states attorney generals office and have them force and possibly fine LJ for supporting such a community.

Hey, I ended up here from another site and wanted to say that I also filed a complaint with them and I'm waiting for a response now. Did you ever hear anything back? This is what I said to them:

"I have nothing to say aside from the fact that if LiveJournal.com does not take action on this, and other communities like this one, that have been reported, then I'm sure that we, the women that are members of livejournal.com, will take action ourselves on the issue. Contrary to popular belief, we are human beings and some of us are journalists, activists, and the like and prepared to make a big, loud fuss about it to anyone that will listen. Ignoring this type of abuse and the sick individuals that perpetuate it is bad business for livejournal and could very well lead to considerable problems for livejournal, which it should care about, even if it does not care about women or human beings in general."

they're not going to do anything about it. blah. blah. balh.

all future correspondence (from me) regarding the matter will be ignored as it has already been addressed.

they have very fucky priorities.

i think this was the last response i got.
i sent it from my more privat journal..

While we completely agree that rape itself is a hateful act, the issue
here lies in whether the content is instructional or clearly and
specifically incites violence against an identifiable group. In this case,
the material does not. Any material not meeting these criteria falls
under the protection of the First Amendment and LiveJournal is absolutely
committed to protecting freedom of speech for its users, regardless of
our personal feelings in the matter.

As we have explained our reasoning on this issue in this and prior
requests, we will not be able to answer any further inquiries in the
absence of posts which do contain clearly instructional references. We regret
that we cannot be of further assistance.
